Title: any lawers from NJ here---help
Post by: paploo on January 21, 2004, 06:10 PM
i got a ticket for driving through private property to avoid a traffic light, and in NJ it is a court required ticket.  My court appearance is monday the 26th, and i checked on the NJ dmv website to find out the fines---$50-200 or up to 15 days in jail or both. All of my friends believe i wont have to go to jail because of this, especially since there wasnt an accident or anything. Is there anything I can do to be sure I wont have to go to jail because of this. I dont care if i have to pay the fine and get the DMV points. PS I would rather not have to get a lawer.

I know in NY, the cop or trooper who is there (or the one that pulled you over) will more than likley offer you a plea bargin, and you'll go that way.

Good luck with that ticket, and drive safe!

I dont think the cop knew this was a court required ticket, because she told me i can go to court and fight it if i want, and they will most likely take away the dmv points. the court clerk when i called for the payment amount was shocked it was court required. she checked in 3 books. i went to the nj dmv website and found most tickets are the same a fine or 15 days in jail. i heard that is so they cover all options for extreme cases. truthfully i am thinking i am worrying for nothing because my friends boyfriend had to go to court for driving without a license and no insurance and he didnt go to jail. I think it is really unlikely i will go to jail for cutting through a parking lot

You are SO going to jail. Start watching "Oz" now so you'll know what you're in for.

These "court required" tickets are for morons usually guest-starring on "COPS" running from the law endangering the lives of innocent motorists and pedestrians along the way. It's just one more thing the law can charge you with after they've chased your butt off the thruway, over sidewalks, and across the Quik-E Mart parking lot.

Plead guilty, and may God have mercy on your soul. Your life is never the same once you've spent time in the big house.

(Unless of course you weren't ticketed in such an extreme context. Then you should request a supporting deposition from the officer in question. If she doesn't deliver, the judge will most likely dismiss the case. Then again, it might be too late for such a request since it's something you usually have to ask for at the time the ticket's issued, but you never know.)

Drive safe, indeed.

In the Chicagoland area, usually if a ticket sends you to court, the cop that ticketed you has to appear or the case is thrown out and you just have to pay the fine on the ticket. Perhaps that is the same case in NJ?

You're in Jersey?  They have real crime there, right?

I'm a lawyer in Utah, and as hard up as we are for real crime (freaky-ass fundamentalist kidnappers aside), even we don't throw people in jail for avoiding semaphores (that's lawyer for "stoplights").

You're not going to go to jail, you'll get a fine...probably the $50 if this is your first traffic infraction.

I had my court appearance today, and boy is it very different then i imagined. I spoke with the procecuter and she dropped the points and I only had to pay 152 + 30 for court fee. I was worried for nothing
