It could all be rumor or even stuff to throw people off the tracks, but I saw that in an interview with Michael Caine (read this at Movies.IGN.com) he mentioned talking to a WB rep and asked "how are you going to top Heath?" and they said "with Johnny Depp as the Riddler and Philip Seymour Hoffman as the Penguin, that's how".  Grain of salt and all that though, its obviously pretty early and we've seen actors declare this type of thing before and be off the mark.

Isn't Philip Seymour Hoffman a little low-key to play the Penguin?  I never really had a good grasp on the Penguin's character anyway.  He's an aristocratic thief or something?  He always seemed like he was pretty lively, which I've never seen Hoffman pull off.

The Joker as an anarchist fit well into the dark, modern Batman.  And I think the Riddler as a psychotic bent on some quest would work as well.  It's more of a stretch... "Why if this guy really wants to get away with it does he leave these crazy clues?"  But it's doable.  But what purpose could the Penguin serve?

Well, first off, the PSH = Penguin rumor has been going since 2006, so I'm inclined to believe it's still just speculation. 

Writer David Goyer said back in July that they are leaning towards "new" bad guys for #3, so I wouldn't be surprised if they stick to that (though anything's possible).

But what purpose could the Penguin serve?

In the current Bat-comics, the Penguin is a mob boss...  After Gotham's earthquake (don't ask  ::)), The Penguin (with help from Luthor) started a black-market for goods in the ruined Gotham City.  He used the cash he made to bankroll his new "semi-legit" nightclub/casino empire.  He still dabbles in crime, but is played as more of a master-mind like Luthor, never getting his own hands dirty.

This version of the Penguin would work well in the movie mythos, as he could just be a quirky new mob boss who stepped in to fill the void created when the Joker killed off some of the Mob Bosses in TDK.  Not really the main baddie, but probably a plot exposition device and or a thorn in Batman's side as he tries to do whatever it is he ends up doing in the movie...

He was all sorts of animated when he played Dusty in "Twister."  Hoffman's a really good actor, I could see him getting into a role where he was not so low-key.

I can PSH as Penguin... He can be evil, intelligent and animated.

Would be interesting to see how it plays out.

It could conceivably be one well-timed, well publicized re-release away from toppling Titanic.

It sounds like Warner Brothers is indeed planning a re-release of The Dark Knight, hitting around January.  I'd really like to see it topple Titanic, but it will probably still be quite a climb.
