I was very willing to give someone $13 for Soundwave, but nobody had the balls to sell it to me, since they're afraid that Hasbro would, well, I don't know exactly. It's not like Hasbro really has any pull here. If anything, I'd imagine that Hasbro would be at the mercy of the retailers, and if they want to sell something, they paid for it, so they have the right.
I worked at a TRU around the time RotS came out and we had to separate the street dated RotS stuff from the others (to avoid leaking product). Stores are actually under Hasbro's pull here because if a store is found to have leaked stuff (and the SW stuff was held back due to LFL as well), a 'hefty' fine is levied on said store and possible 'rights' to carry future street-dated product could be pulled, plus having the ire of district managers and corporate on your back for losing that amount of cash for selling the stuff.
That being said, I believe if a store does have the merchandise on the shelves and pegs, they are obliged to sell it (isn't there even a law regarding this?). There are no signs posted saying 'look but you can't buy'. It's only until you get to the register that it stops you from buying it, so I think it's rather unfair to the customer to get excited, grab something to purchase only to be denied.
