I don't think so. As long as you're selling it for what you PAID for it, then I think you're OK. Lots of folks seem to do that. I just did that a few months ago, when I wussed out and bought my first ever case of figures from an e-tailer 'cause I was nervous I'd miss them at retail. I snagged the ROTJ VOTC case from EE, which came out to about $12.15 per figure. So when I wound up having no problem finding the same figures at retail later on, I put mine up on the boards (RS) for $12.15 each, specifically noting that that was the price I paid for them from EE, hence I wasn't "scalping" them. Didn't have any problems, and actually wound up selling most of them.
So if you get stuck with both Chrome Stormies, just sell the more expensive one, and state that it's $xx because that's what you paid for it from FP, and that it's not from SWS.com. Recouping your actual costs should never be considered "scalping". It might mean your an impatient
dumbass for paying too much to get it in the first place, but not a scalper for selling it for that same amount later on.
